NEXO S.A. is strongly committed to protecting the privacy of your personal information, and this privacy statement explains how NEXO treats your personal information when you use this site.  By using this site and submitting any personal information, you agree to the use by NEXO S.A. (“NEXO” or “we”) of such data in accordance with this privacy statement.

1.Data collection

NEXO collects personally identifiable information which is specifically and voluntarily provided by visitors to NEXO’s website. In addition, NEXO may combine information collected through means such as cookies or third-party analytics tools with personal information maintained by NEXO.  NEXO may collect certain personally identifiable information, such as name, job title, and company name, address, email address, telephone and fax numbers, from website visitors. A visitor may choose to provide personal information in the following examples:

Submit resumes or work history information

Participate in “join our mailing list” initiatives

Demographic information, including gender and occupation, is not actively sought, but may be submitted when a visitor responds to an online job application. It is NEXO’s policy to limit the information collected to only the minimum information required to complete a visitor’s request. If a visitor believes the site has collected excessive information, we encourage the visitor to contact us at [email protected] to raise any concerns.  In any instance where non-mandatory personal information is sought, the website visitor will be notified of this at the point of collection.

Visitors are also able to send email through the site. Their messages will contain the user’s screen name and email address, as well as any additional information the visitor may wish to include in the message. NEXO’s intention is not to seek any sensitive information through our website unless legally required. Sensitive information includes a number of types of data relating to: race or ethnic origin; political opinions; religious or other similar beliefs; trade union membership; physical or mental health; sexual life or criminal record. We suggest that you do not provide sensitive information of this nature. If you choose to provide sensitive information for any reason, NEXO accepts your explicit consent to use that information in the ways described in this privacy statement or as described at the point where you choose to disclose this information.

2.Use of data

When a visitor provides personal information to us, we use it for the purposes for which it was provided to us as stated at the point of collection (or as obvious from the context of collection).  Examples of the types of use are given in the ‘Data collection’ section above. We may also use your data to contact you with information about NEXO’s business, services and events, and other information which may be of interest to you.  You may unsubscribe from our mailing list at any time by contacting us as set out in the ‘Unsubscribe’ section below or through the unsubscribe link in our communication to you.  NEXO may also use your information in order to administer and manage the site or communicate with you about the site.

3.Your Rights

3.1 General rights

You have a right to information, rectification, erasure, restriction of data processing, to object against the data processing and to data portability. To the extent a data processing is based on your declaration of consent, you have the right to revoke such consent with effect for the future.

3.2 Rights concerning data processing conducted on the basis of a legitimate interest

Article 21 para. 1 GDPR gives you the right to object against the processing of your personal data on the basis of Article 6 para. 1e GDPR (data processing in the public interest) or Article 6 para. 1f GDPR (data processing to safeguard a legitimate interest) for reasons resulting from your personal circumstances at any time, including against a profiling based on the same provision. We will cease to process your personal data if you object against it, unless we demonstrate compelling legitimate reasons for the data processing that prevail over your interests, rights and freedoms, or if the data processing serves the purpose of asserting, exercising or defending legal interests.

3.3 Rights concerning direct advertising

In as far as we process your personal data for direct advertising purposes, Article 21 para. 2 GDPR gives you the right to object against the processing of your personal data for the purpose of such advertising, including profiling to the extent it is related to direct advertising.

We will cease processing your personal data for direct advertising purposes if you object against such use of your personal data.

3.4 Right to lodge a complaint with a supervisory authority

You have the right to lodge a complaint about the processing of your personal data by us with the relevant data protection supervisory authority.

4.Personal data collected when visiting our website

 Where our website is only used for the purpose of gathering information, meaning without you registering or transmitting information to us otherwise, we will only collect the personal data transmitted by your browser to our server. When you surf our website, we will collect the following data required by us to display our website to you and ensure its stability and security. The legal basis for this collection of data is Article 6 para. 1f GDPR:

–IP address, date and time of the request, time zone difference to Greenwich Mean Time (GMT), content of the request (specific page), access status/HTTP status code, data transferred, referring website, browser, operating system and surface, browser language and version.

5.Cookies and log files

Cookies may be used on some pages of our site. “Cookies” are small text files placed on your hard drive that assist us in providing a more customized website experience. For example, a cookie can be used to store registration information in an area of the site so that a user does not need to re-enter it on subsequent visits to that area. It is NEXO’s policy to use cookies to make navigation of our website easier for visitors and to facilitate efficient registration procedures.

NEXO also uses site analytics providers which may set cookies in your browser.  Site activity information collected by these analytics providers may be combined with personal information held by NEXO.

In order to properly manage our website we also anonymously log information on our operational systems and identify categories of visitors by items such as domains and browser types. 6.Third parties

Personal data collected by NEXO may be transferred or disclosed to NEXO’s authorized distributors and dealers for the purposes for which the visitor has submitted the information and for the administration of our system or site and/or other internal, administrative purposes. Personal data may also be transferred to third party service providers of identity management, website hosting and management, data analysis, data backup, security and storage services. As a result, personal data may be transferred outside the country where the visitor is located. By submitting data on NEXO’s website, the visitor is providing explicit consent to the transfer of such data for the fulfilment of his or her voluntary requests or  otherwise as set out in the ‘Use of data’ section.

It is NEXO’s policy to disclose information to third parties under the following circumstances:

When explicitly requested by a visitor

When required to deliver publications or reference materials requested by a visitor

Third party links

NEXO’s website may link to other websites which do not operate under NEXO’s privacy practices. When you link to other websites, NEXO’s privacy practices no longer apply. We encourage visitors to review each site’s privacy policy before disclosing any personally identifiable information.

7.Data retention

The personal data you submit to us will only be retained for as long as is required for the purposes for which it was collected. Contact information about visitors such as mailing list information is kept until a user unsubscribes to a publication or requests that we delete that information. Resumes are disposed of when they are either no longer under consideration or are considered outdated by our Human Resources department.

8.Unsubscribe

Should visitors subsequently choose to unsubscribe from mailing lists or any registrations, we will provide instructions within the appropriate website area or in communications to our visitors; or a visitor may contact the webmaster of the site e.g., [email protected]

9.Access

Visitor updates of information should be handled by going back through the registration process. Inquiries about the accuracy of identifying information previously submitted to NEXO through its website, or requests to have outdated information removed, should be directed to: [email protected]

NEXO is committed to providing reasonable and practical access to visitors to allow them the opportunity to identify and correct any inaccuracies. When requested and practical, NEXO will delete identifying information from current operational systems.

When personally identifiable information is retained, NEXO assumes responsibility for keeping an accurate record of the information once a visitor has submitted and verified the data. NEXO does not assume responsibility for verifying the ongoing accuracy of the content of personal information. When practically possible, if NEXO is informed that any personal data collected through a website is no longer accurate, NEXO will make appropriate corrections based on the updated information provided by the authenticated visitor.

10.Security

NEXO has implemented generally accepted standards of technology and operational security in order to protect personally identifiable information from loss, misuse, alteration or destruction. Only authorized NEXO personnel are provided access to personally identifiable information and these employees have agreed to maintain the confidentiality of this information.

11.Website analysis

This website uses Google Analytics, a web analysis service offered by Google Inc, (1600 Amphitheatre Parkway Mountain View, CA 94043, USA). We use Googly Analytics in the universal analytics mode. This allows for the allocation of data, sessions and interactions to a pseudonymous user ID across multiple devices and therefore an analysis of the user’s activities across multiple devices.

Google Analytics uses cookies to analyse your use of our website. The information about your use of the website generated by the cookie is generally transferred to a Google server in the USA, where it is saved. If IP anonymisation is activated on this website, your IP address will be truncated by Google within Member States of the European Union or in other States party to the Agreement on the European Economic Area. The full IP address will only be transferred to a Google server in the USA and truncated there in exceptional cases. The IP address sent by your browser for the purposes of Google Analytics will not be merged with other data. Google will use this information on behalf of the operator of this website to evaluate your usage of the website, to compile reports on the website activities, and to provide the website operator with additional services related to website and internet use. These purposes establish our legitimate interest in processing the data. The data that is sent by us and linked with cookies, user names (e.g. user ID) or advertising IDs will be deleted automatically after 14 months. Data that has reached the maximum retention period is deleted automatically on a monthly basis.
